Privacy Policy

Brokersaathi is concerned about the safety and privacy of all its Partners. The Brokersaathi Privacy Policy governs use of the Brokersaathi platform and/or the services.

Brokersaathi is not supposed to intentionally monitor or disclose any private e-mail message or address information unless required by any law, or order of court or any statutory authority. You agree to respect the privacy and confidentiality of others. Please refer to the below mentioned policies for further details.

• The Partner shall not infringe on any intellectual property rights of any person or/and retain information in any computer system or otherwise with an intention to do so. The Partner shall give out to The Holding Company a non-exclusive, worldwide, royalty-free, irrevocable, sub-license able (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or User Data displayed in our listings. For the purpose of this Agreement, "User Data" shall mean all information (if any) submitted by the Partner to Brokersaathi with the exception of trading data, credit card numbers, checking account numbers or other banking details. The User Data shall be deemed to be the property of Brokersaathi. The Partner shall take all reasonable efforts to ensure that it is accurate and complete and not misleading in any way.
• Dealings with advertisers - Brokersaathi does not endorse any advertiser or any of their products. Any of your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Brokersaathi platform, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, is solely between you and such advertiser. You agree that Brokersaathi shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Brokersaathi platform.
• Disclaimers/Limitation of liability
• Disclaimers:Brokersaathi will take all possible measures to avoid any misrepresentation, fraud, illegal and unlawful action/inaction by any person using services of Brokersaathi but does not guarantee for any accuracy, correctness and or reliability of any such information/content. As a Partner, you are expected and assumed to be alert and check the accuracy and correctness of any information submitted by any Partner on the Brokersaathi platform. Anything provided in this network is only for your reference and should not be treated as an advice of Brokersaathi and before using or putting into any use any such advice, or draft document you must consult a Legal practitioner.
• Your use of the Brokersaathi service is at your sole risk. Please note that this Agreement strictly limits our liability and Brokersaathi does not provide any warranty for the service. The Agreement also limits your remedies
• Brokersaathi shall not be liable or responsible to verify the authenticity of the content posted by Partners on the platform such as, property price, plan, location, opinion/suggestions etc and shall be in no way be responsible for any loss/damages caused to the Partners . Brokersaathi is not responsible for any incorrect or inaccurate content posted in the platform or in connection with the Brokersaathi services, whether caused by Partners or by any of the equipment or programming associated with or utilised neither in the service, nor for the conduct of any Partner and/or Partner of the Brokersaathi platform whether online or offline
• Brokersaathi does not guarantee confirm the financial capability of any Partner and does not acknowledge any ownership or guarantee for complying with the obligation between the property buyer and seller Or licensor/lessor and licensee lessee
• Brokersaathi assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, Partner and/or Partner communications
• Under no circumstances will brokersaathi be responsible for any loss or damage resulting from anyone's use of the platform or the service and/or any content data posted on the Brokersaathi platform or transmitted to its Partners. The exchange of any information/messages through Brokersaathi should not in any way be construed as any offer and/or recommendation from/by Brokersaathi.
• Brokersaathi shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, relations established pursuant to the use of Brokersaathi. The platform and the service are provided "as-is". Brokersaathi cannot guarantee and does not promise any specific results from use of the platform and/or its service
• An material downloaded or otherwise obtained through the use of the service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
• Brokersaathi disclaims any liability, whatsoever, arising out of or in connection with the services being offered though Brokersaathi
• The Partner shall ensure that while using the service, all prevailing and applicable laws, rules and regulations, directly or indirectly for the use of systems, service or equipment shall at all times, be strictly complied with by the Partner and The Holding Company shall not be liable in any manner whatsoever for default of any nature regarding the same by the Partner
• Brokersaathi shall not be liable for any disclosure of information concerning the Partner's account and/or particulars nor for any error and or omissions and or inaccuracy with regard to information so disclosed.

In addition Brokersaathi shall further not be liable for any loss or damages sustained by reason of such disclosure, weather intentionally or inadvertently

• The Holding Company does not provide guarantee that the Brokersaathi platform will be free of any operational hazards or errors nor that it will be free of any virus or/and any other harmful components
• Brokersaathi may not be involved in transaction between any parties who are using the platform and might just act as a source of information. There are risks, which the Partner assumes when dealing with people who might be acting under false pretences and the same shall be borne by the Partner. The platform is a venue only and does not screen or/and censor or/and otherwise control the listings offered to other Partners . Brokersaathi cannot and does not control the behaviour of the participants on this platform. We cannot control whether or not Partners of Brokersaathi will complete the transactions they describe on the platform. It is extremely important that the Partner takes care throughout his/her dealings with other people in the network. Brokersaathi does not accept or/and assume responsibility for the content or/and context of the comments entered and will not remove or/and edit postinas to the commerus once ney are entered into the platform, except in violation of the posting policy mentioned above or to expire records.
• Assignment: Brokersaathi may assign this Agreement to anybody with or without notice to you.
• Indemnity:You agree to indemnify and hold The Holding Company, Brokersaathi, its subsidiaries, directors, affiliates, officers, agents, and other Partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Brokersaathi platform in violation of this Agreement and/or arising from a breach of any of the terms of this Agreement and/or any breach of your representations and warranties set forth above.
• Notice:Any notice required to be given under this or in connection with this Agreement, may be given by email and it shall be treated as given in writing in compliance with any laws, which require such notice to be given in writing. And such notice shall be deemed to be duly received by you once it is sent to your email id updated by you from time to time. You can send any notice to The Holding Company by registered post address as mentioned in contact us section and it shall be deemed as received by The Holding Company only after actual physical receipt of such notice
• For the purpose of this Agreement and attachments thereto and all renewals, "Confidential Information" means all financial, commercial, technical, operational, staff, management and other information, data and know-how relating to the Service of a party, which may be supplied to or may otherwise come into the possession of the other, whether orally or in writing or in any other form, and which is confidential or proprietary in nature or otherwise expressed by the Dingaling Party or by otherwise expressed by the Disclosing Party or by any of its Associates to be confidential, and not generally available to the public. The Party disclosing the Confidential Information under this Agreement is also referred to as the "Disclosing Party" and the Party receiving the Confidential Information under this Agreement as the "Receiving Party".
• The Receiving Party shall keep confidential and secret and not disclose to any third party the Confidential Information nor any part of it, except to any of the Receiving Party's Associates, if required and upon prior permission in writing from the Disclosing Party. The Receiving Party agrees to take all possible precautions with regard to protecting confidential information from any third party and shall ensure that all its Associates to whom such disclosure e is made will act in accordance with the terms of this Agreement as if each of them were a party to this Agreement, and if required obtain a written statement from each of its employees/associates having access to such Proprietary Information undertaking to abide by the confidentiality conditions. All Proprietary Information shall be kept separate and exclusive and at the usual place of business or residence as the case may be) of the Receiving Party.
• The obligations of confidentiality set out in this Agreement shall continue to be in force notwithstanding termination of this Agreement for any reason whatsoever. All information and data submitted by the Partner shall become the property of The Holding Company.
• The Partner has editing access to only his own data and information stored in the database of Brokersaathi (subject to confirmation of identity). The Partner may edit or amend such data and information from time to time.
• All confidential information (including name, e-mail address etc.) voluntarily revealed by the Partner, is done at the sole discretion and risk of the Partner. If such information, collected by a third party is misused or results in unsolicited messages from such third parties, then such actions are beyond the control and liability of Brokersaathi and The Holding Company accepts no responsibility or liability whatsoever for such actions.
• All copyright and/or know-how and/or any other related intellectual property rights to the service or Brokersaathi shall become and remain the sole and exclusive property of The Holding Company and the Partner shall have no claims to the same. In the event the Partner has contributed any content to Brokersaathi in any manner whatsoever, all intellectual property rights to the same shall become the absolute property of The Holding Company, including all intellectual property rights and the Partner shall have no right or claim over the same, in any manner whatsoever. In the event that the Partner during the term of this Agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same shall be considered as an infringement of the intellectual property rights of The Holding Company and The Holding Company shall have the right to take recourse to whatever legal remedial action is required, in the given facts and circumstances, the costs and peril of which will lie at the end of the Partner.
• If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. You are under an obligation to report an misuse or abuse of the brokersaathi portal by writing to the mail id [email protected]
• Any false complaint made by a Partner shall make him/her liable for termination of his/ her membership without any refund of the subscription fee. Any Partner makes/indulges directly or indirectly in making false complaint against any other registered Partner/potential Partner then, Brokersaathi shall be entitled to recover all loss, costs, expenses, damages etc which may be incurred by Brokersaathi due to action taken on the basis of such false information/complaint.
